Judge Retires after New Sexual Harassment Complaint

Judge W. Fred. Axley, 70 was originally elected in 1982 as a Criminal Court judge in Shelby County, Florida. Of late, he was permanently barred from a Florida resort due to a sexual harassment complaint made by one of the resort's female employees.

Since that time, he has announced his retirement, while stating that the sexual harassment complaint had nothing to do with his decision to retire. In a letter to Governor Phil Bredesen he stated "My years in criminal justice have been both challenging and personally fulfilling," adding that he and his wife "are looking forward to the various opportunities and challenges that lie ahead."

A review of the judge's record shows that in 2000 and 2001 two court clerks filed harassment suits against the him. Those suits were dismissed.

For more information on this subject, please refer to our section on Workplace Injuries and Discrimination.

Originally posted at InjuryBoard by Susy Owen

Judge Involved in Sexually Harassment Scandal

Liz Overstreet filed a wrongful termination complaint to the Texas Work Force Commission in February of this year. Additionally, she filed a complaint with the Texas Judicial Commission. Overstreet claims that she was sexually harassed by the Lubbock County Sheriff's Court Bailiff Leroy Morrison. More specifically, her claim centers around inappropriate hugging by Morrison. Overstreet further claims that as a result of the filings she was wrongfully terminated.

"Right now, I can't get into the specifics of the allegations, responses to the allegations and any support for either side, is covered under a confidentiality rules both by the state and judicial commission and TWC," says Shawn Twing, Judge Brad Underwood's Attorney.

Apparently, the day after she filed a complaint on Morrison, Judge Underwood accused her of sexually harassing him. They say timing is everything. It can take more than 6 months for the Texas Work Force Commission or Texas Judicial Commission to make a ruling.

Originally posted at InjuryBoard by Susy Owen

Former Justice Minister Guilty of Sexual Misconduct

On Wednesday, the former Israeli justice minister Haim Ramon, was found guilty of sexual misconduct against a young female solder. Ramon was accused of forcibly kissing a 20-year-old soldier.

1. The kiss (sexual misconduct, depending on who you ask) took place after what Ramon considered to be a flirtatious conversation between the two. The judge in the case admonished Ramon for distorting the facts in a devious and crafty way during his trial. Ramon vowed to appeal the conviction. In his view, many questions have come to light during the reading of the verdict.

Originally posted at InjuryBoard by Susy Owen

Sexual Harassment Santa Fe

Two Santa Fe County's juvenile jail workers contend that they were terminated after complaining to a supervisor about having been sexually harassed while working. The county's legal department investigated and as a result one employee resigned while another worker was fired.

An additional complaint that was made to the supervisor was that the employees who had been sexually harassing them were also using work computers to find pornography on the internet. There have been additional complaints by other current and former employees since the latest incident was reported

Originally posted at InjuryBoard by Susy Owen

Burlingame Restaurant Settles Sexual Harassment Lawsuit

Owners of a now defunct Burlingame restaurant must compensate their former female employees a total of $230,000 for sexual harassment, the U.S. Equal Employment Opportunity Commission announced.

First Watch Restaurant, part of a corporation that has moved it's only California location out of state, has been ordered to pay the money as part of a settlement. Additionally, the corporation must also revamp their anti-discrimination policies and sexual harassment training.

The settlement involved at least two women and a 16-year-old girl. According to EEOC District Director Joan Ehrlich, often times minors are the ones who are most affected by inappropriate behavior within the restaurant industry and there may be more who are yet to come forward in this case.

The suit alleged that while First Watch Restaurants did have sexual harassment policies in place, it failed to implement them on a local level. Based in Bradenton Florida, the corporation operates 52 breakfast and lunch restaurants located in seven different states.

William Tamayo, the lead attorney in the case, said First Watch was cooperative in settling the lawsuit.
``We are optimistic that their training programs and complaint procedures put in place by the consent decree will prevent further instances of harassment,'' Tamayo said.

A spokesperson for First Watch declined to comment this morning.

Originally posted at InjuryBoard by Christina Cole
