It took as little as 35 minutes for a jury to find a Parsons doctor innocent of malpractice yesterday. The patient, Richard Giles, who is a diabetic, had been treated by Dr. Buller for 20 years. Two physicians testified that Dr. Buller did everything he could, and he did not fall below the "standard of care" while treating the patient.

In fact, the jury felt that not only did Dr. Buller meet the required "standard of care" for a patient, he went above and beyond that standard when trying to identify the problem.

While trying to build a case for medical malpractice, the defense argued that according to the testimony of his expert witness, Dr. Richard Shaffer, Dr. Buller should have consulted with an infectious disease specialist at the onset treatment. However, as was pointed out by a witness for the defense "He did meet the standard of care with regards to consulting an infectious disease specialist," Dr. Dennett said. Dr. Buller had consulted with an orthopedist, who also would be qualified to diagnose the uncommon ailment known as discitis.
