Negligence:

Negligence refers to conduct that is culpable because it falls short of the legal standard which protects people from foreseeable, risky, harmful acts by another individual. When one acts negligently toward another, the harmed person has a right to be compensated for any harm that you may have cuased to their person and/or proprerty. In essence, you must make the injured party "whole."

Duty of Care:

A reasonable person's standard is used. A reasonable person would foresee that another will be put at risk by a particular act or omission of an act. For example, when one drives a vehicle a duty of care is owed to others such as other drivers, passengers, pedestrians, and the owners and dwellers of surrounding land and buildings. On the other hand, no duty is owed to those who are not foreseeably at risk from a given activity.

By understanding different aspects of the law and how it relates to you can become more protected by applying your knowledge to your everyday living.
