Mississippi Supreme Court will hear appeal of judgment against UMC

The University of Mississippi Medical Center has been accused of medical malpractice for failing to diagnose a patient's case of pneumonia, which subsequently led to that patient's death. In May the state Court of Appeals upheld the malpractice award, and now the case will be heard by the Supreme Court.

After the case was ruled in the favor of the family of the decedent in 2005, The University of Mississippi had argued that not only was hearsay allowed in, but evidence that was in the hospital's favor was kept out. The Court of Appeals did not see it that way and upheld the verdict, which brings us to the current state of affairs.

The decedent entered the hospital for a Caesarean section in 1999 she had pneumonia that went undiagnosed. She was sent home, and she died several days later on August 22, 1999. The lady that shared a room with her said the decedent had complained of having a feeling of drowning when she laid down. Upon review of the case the Court of Appeals found that the presiding judge had indeed given consideration to both the plaintiff and the defendant.
